RECORDING Defense Practice and Prosecution Perspective on the Racial Justice Act

The California Racial Justice Act (“RJA”), codified in Penal Code section 745, prohibits the State from seeking or obtaining a criminal conviction or imposing a sentence based on race, ethnicity, or national origin. It provides those who have been harmed by racial bias and discrimination in the criminal legal system the right to seek relief.
